HIRE CONTRACT - TERMS & CONDITIONS

This hire agreement relates to the ÎHirer' ö the person(s) or Company hiring the goods detailed overleaf, and The Parker-Bowles Co Ltd, T/A TopiaryShop.co.uk, registered address of 209 Birchanger Lane, Bishops Stortford, Herts.

PLEASE READ THE FOLLOWING CAREFULLY;-

•  The hired plants, pots and any other items belonging to TopiaryShop.co.uk will remain at the address/location as delivered by TopiaryShop. Under no circumstances will they be removed to another location without the express consent of TopiaryShop. Should the hirer or venue prevent us from collecting any or all of the hired items at the time specified, we reserve the right to charge for any additional hire period and waiting time.

•  The hirer must call TopiaryShop.co.uk on 0845 230 6008 in order to Îoff hire' the goods hired. The hire contract shall continue until TopiaryShop.co.uk is notified otherwise. The goods hired remain the responsibility of the hirer until TopiaryShop.co.uk is notified to collect.

•  The goods listed above remain the property of TopiaryShop.co.uk at all times during the hire period. TopiaryShop.co.uk, or its legally appointed agents, reserves the right to gain access to property at all reasonable times should it become necessary to reclaim the goods hired.

•  All goods hired will be cared for by the hirer to the best of their ability, and any breakages/damages, theft, total loss, however caused will become chargeable to the hirer at the full retail cost. You will also become liable for additional charges, please see section 8 below.

•  No liquids/fluids/decoration/lighting or any other matter or material are to be added or attached to the compost or plant, whether accidental or otherwise, unless TopiaryShop.co.uk have granted their express permission.

•  On hires covering a period exceeding 48hrs, the plants may have to be watered with mains tap water. You will have received instruction on how to do this should this become necessary.

•  During the hire period, in the event of any loss or damage (however caused) of any plants or other items hired to us by TopiaryShop.co.uk, you agree to reimburse TopiaryShop.co.uk to the full retail cost of the goods lost. You also agree to pay other expenses, i.e. travelling, purchasing costs, administration, carriage costs, and the loss of hire revenue until TopiaryShop.co.uk can replace the goods lost or damaged. Remember, you are responsible for all items hired to you under this agreement from the point of delivery to you until the hire contract ceases, and all items hired are safely collected and or, returned to TopiaryShop.co.uk

•  Cheques received by us and subsequently returned by your bankers unpaid, will attract an Unpaid Cheque Fee of GBP50.00. This fee will apply each time an item is returned unpaid by your bankers.

•  We may, at our discretion, extend you credit terms. If we fail to receive payment within our stated terms as per our invoice, we reserve the right to charge a one time late payment fee of £25.00. For every additional full day the account remains overdue, we reserve the right to charge 2.5% of the outstanding net amount daily in respect of late payment fees. You are responsible for ensuring the account has been paid in full.

•  Please ensure all ties/wires/decorations etc. are removed from the hired plants, unless they are the property of Topiaryshop.co.uk. Remedial work to remove decorations or repair damaged plants is charged at £50.00 per hour, with the minimum charge being £50.00.

•  Any booking deposits taken by us are non-refundable in the event of your cancellation for whatever reason.

•  We will require a valid credit card number, Company or Personal, in order to secure your booking. Please note that we do not accept 'American Express' cards or 'Visa Electron'. We cannot and will not allow a hire contract to commence without a valid credit card number on record.

•  You are strongly advised to have adequate insurance cover in place, to guard against theft, fire, flood or accidental damage to any hired plants or other goods belonging to TopiaryShop.co.uk. You, as the hirer are responsible.

•  Placing an order with us verbally, by phone, internet, or any other method of communication constitutes you having read, understood and agree to these terms.
